Terms of Service

These Terms are a legal agreement between you and Kirtika Yadav, operating as a sole trader as "Kirvik" ("we", "us"), governing your use of the Kirvik app and related services (the "Service"). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use Kirvik and confirm the information you provide is accurate.

2. Your account

You're responsible for keeping your credentials secure and for activity under your account. You may sign in with email/password or a supported provider (e.g. Google).

3. The Service

Kirvik helps you catalogue your wardrobe and generates outfit suggestions using AI. Suggestions and any AI-generated content are for inspiration only, are produced automatically, and may be inaccurate or not to your taste. You are responsible for your own styling and purchasing decisions.

Some features generate images — including "ghost mannequin" cut-outs of your garments and an optional on-model try-on that shows an outfit on a faceless, AI-generated model. These renders are AI approximations for visualisation: they may not reproduce a garment's exact colour, cut or detail, do not depict a real person, and should not be relied on as an accurate representation of any product.

4. Your content

You keep ownership of the images and content you upload ("Your Content"). You grant Kirvik a limited, worldwide, non-exclusive licence to host, store, process and display Your Content solely to operate the Service for you (including the AI processing described in the Privacy Policy). We don't claim ownership and don't use it for advertising.

5. Subscriptions, billing & refunds

Kirvik offers free and paid tiers, processed by Stripe and/or the App Store / Google Play. Subscriptions auto-renew until cancelled; cancel anytime and access continues to the end of the period. Refunds follow the policy of the platform you purchased through and applicable consumer law. As an EU/UK consumer you may have statutory withdrawal rights; starting to use a digital service immediately may waive part of the withdrawal period. Prices may change with prior notice.

6. Acceptable use

Don't use the Service unlawfully; upload illegal or infringing content; reverse-engineer, scrape, overload or disrupt it; circumvent limits or security; or use it to build a competing product. We may suspend accounts that violate these Terms.

7. Third-party services

The Service integrates third-party providers (see the Privacy Policy) and may link to retailers. We're not responsible for third-party content, products, prices or practices.

8. Intellectual property

The Kirvik name, logo, app and software are ours and protected by IP law. These Terms grant only the limited right to use the Service as intended.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties, to the fullest extent permitted by law. We don't warrant that it will be uninterrupted or error-free, or that AI outputs will be accurate or suitable. Nothing here excludes liability that cannot be excluded by law, including your statutory consumer rights.

10. Limitation of liability

To the fullest extent permitted by law, Kirvik isn't liable for indirect, incidental or consequential losses, or loss of data or profits. Nothing limits liability for death or personal injury caused by negligence, for fraud, or any liability that can't be limited by law. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and delete your account anytime (Settings → Privacy & data → Delete account). We may suspend or terminate access for breach or where legally required. §§ 8–10 survive termination.

12. Changes

We may update these Terms; material changes will be notified in the app or by email and take effect on the stated date.

13. Governing law

These Terms are governed by the laws of Germany, and the courts of Berlin have jurisdiction, without prejudice to mandatory consumer-protection rights in your country of residence.
